These Terms of Service ("Terms") govern your access to and use of the Tarmac mobile application (the "App") operated by Nicholas Daras ("we", "us", "our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 13 years old to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
By using the App, you represent that:
You must create an account to use the App. You agree to provide accurate, current, and complete information during registration and to keep your information up to date.
You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at tarmacapp@outlook.com if you suspect unauthorised access to your account.
You may not create multiple accounts to circumvent a suspension or ban, or to mislead other users.
You retain ownership of all content you post to the App ("User Content"), including drive photos, descriptions, and comments. By posting User Content, you grant us a non-exclusive, royalty-free, worldwide licence to store, display, and distribute your User Content solely for the purpose of operating and providing the App to you and other users. This licence ends when you delete the content or your account.
You agree not to post User Content that:
We reserve the right, but are not obligated, to remove any User Content that violates these standards or that we determine, in our sole discretion, is harmful to the App or its users.
If you encounter content that violates these Terms, use the in-app report function. We take reports seriously and will act on them in a timely manner.

You are solely responsible for your own safety and the safety of others while driving. The App is a tool for recording and sharing drives — it is not a navigation aid and should not be used as one while a vehicle is in motion.
We expressly disclaim any liability for accidents, injuries, fines, or legal consequences arising from your use of the App while operating a vehicle.
The App, including its design, code, name, logo, and all non-user-generated content, is owned by or licensed to us and is protected by intellectual property laws. You may not copy, reproduce, or create derivative works based on the App without our prior written consent.
The name "Tarmac" and associated branding are proprietary. You may not use them without permission.
The App relies on third-party services (including Supabase for backend infrastructure and Apple for push notifications). We are not responsible for the availability, accuracy, or conduct of those services. Your use of third-party services is subject to their own terms and privacy policies.
You may delete your account at any time using the "Delete Account" option in your Profile settings. Deletion is permanent and all your data will be removed in accordance with our Privacy Policy.
We may suspend or permanently terminate your account, without notice, if we reasonably believe you have violated these Terms. We will not be liable to you for any termination of your account except where required by applicable law.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

10.1 WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.
10.2 OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRIOR TO THE CLAIM (IF ANY); OR (B) ZAR 2,000 (TWO THOUSAND SOUTH AFRICAN RAND).
10.3 WE ARE NOT LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM YOUR USE OF THE APP WHILE DRIVING, ANY ROAD TRAFFIC ACCIDENT, FINE, INJURY, OR DEATH IN CONNECTION WITH YOUR USE OF THE APP.
10.4 SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
These Terms are governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved informally by contacting us at tarmacapp@outlook.com. If the dispute is not resolved within 30 days, it shall be submitted to the courts of South Africa.
If you are a consumer resident in the European Union, you may also have access to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
We may modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, sending a notification through the App. Your continued use of the App after any changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, stop using the App and delete your account.
